</h3><p style="font-stretch: normal; line-height: normal; font-family: ".PingFang SC"; color: rgb(69, 69, 69);"><span style="font-family: ".PingFangSC-Regular"; font-size: 17pt;"> 經(jīng)調(diào)查了解，事發(fā)地點是位于東趙村下蒲組的一塊集體用地，該土地目前由東趙村下蒲組向張某某承包，張某某在該地非法圈地建圍墻，去年</span><span style="font-family: ".SFUIText"; font-size: 17pt;">11</span><span style="font-family: ".PingFangSC-Regular"; font-size: 17pt;">月份西安市國土資源局臨潼分局已對張某某下發(fā)責(zé)令拆除（清理）通知書和行政處罰決定書，責(zé)令張某某限期拆除違建圍墻，張某某遲遲未拆除圍墻，土地部門表示自己也沒有權(quán)利強(qiáng)制拆除，現(xiàn)在已經(jīng)申請法院請求強(qiáng)制執(zhí)行，引起了東趙村下蒲組部分村民不滿，于是村民蒲某某、阮某某、陳某某等人于</span><span style="font-family: ".SFUIText"; font-size: 17pt;">4</span><span style="font-family: ".PingFangSC-Regular"; font-size: 17pt;">月初商量如何維權(quán)，有人提出自行把圍墻推倒，得到了其他人的認(rèn)可。</span><span style="font-family: ".SFUIText"; font-size: 17pt;">4</span><span style="font-family: ".PingFangSC-Regular"; font-size: 17pt;">月</span><span style="font-family: ".SFUIText"; font-size: 17pt;">11</span><span style="font-family: ".PingFangSC-Regular"; font-size: 17pt;">日上午，阮某某聯(lián)系了挖掘機(jī)達(dá)到現(xiàn)場，指揮挖機(jī)將該廠子大門前的路挖斷，后來在場村民起哄稱把路挖斷沒用，把墻推倒才有用，周圍村民紛紛“響應(yīng)”，于是陳某某、蒲某某等人指揮挖掘機(jī)將圍墻推倒。村民陳某某、蒲某某、阮某某的這種過激維權(quán)行為，已經(jīng)觸犯了法律。對于行走于法律邊緣的非法維權(quán)行為，猶如“站在刀尖上行走”的夜行者，已經(jīng)滑向犯罪深淵而不自知。</span></h3><h3>

</h3><p style="font-stretch: normal; line-height: normal; font-family: ".PingFang SC"; color: rgb(69, 69, 69);"><span style="font-family: ".PingFangSC-Regular"; font-size: 17pt;"> 在整個事件中，村民路挖斷、墻推倒的兩種過激行為，其出發(fā)點都是為了維護(hù)自身權(quán)利，人人都喊著“自家地兒容不得外人侵占”，可別人違法不是自己犯罪的理由，路挖斷了、墻推倒了，問題就得到了解決嗎？過激行為對解決問題毫無幫助，反之帶來更多麻煩。而且私自拆除建筑本身就是違法行為，追究起來參與者都會受到處罰，沖動不能解決問題。</span></h3><h3>
</h3><p style="font-stretch: normal; line-height: normal; font-family: ".PingFang SC"; color: rgb(69, 69, 69);"><span style="font-family: ".PingFangSC-Regular"; font-size: 17pt;"> 民警提醒：法治社會維權(quán)方式雖然可以多樣，但前提只有一個，即必須堅持依法維權(quán)，受侵害的合法權(quán)益也才能得到法律的保護(hù)。但如果采取非法方式進(jìn)行維權(quán)，不但不會討回公道，反而會弄巧成拙、反勝為敗，承擔(dān)相應(yīng)的法律責(zé)任，得不償失。</span></h3>
